Direct Acquisition Under RA 12009 - What Suppliers Should Understand

Published: September 6, 2026

Independent information platform. Official law, IRR and procurement documents control.

Direct Acquisition is one of the procurement modes introduced under the New Government Procurement Act.

In NPM No. 004-2026, dated April 20, 2026, GPPB - TSO issued guidance on the interpretation and application of Direct Acquisition under Section 32 of the IRR of Republic Act No. 12009.

What is Direct Acquisition?

GPPB - TSO explains that Direct Acquisition allows a Procuring Entity to directly purchase goods or services from a known and reputable source without conducting a canvass or requesting quotations, subject to the conditions prescribed by RA No. 12009 and its IRR.

GPPB - TSO has separately explained that Section 32 covers qualifying non-common-use supplies and equipment, common-use supplies and equipment not available from PS - DBM, and services with an Approved Budget for the Contract not exceeding PHP 200,000, subject to the law and any later adjustment authorized by GPPB.

The amount alone is not enough

A relatively small procurement does not automatically qualify. The Procuring Entity must still determine that the statutory and regulatory conditions are satisfied.

Why suppliers should know about it

Direct Acquisition means ordinary commercial suppliers may become relevant to certain government purchases even where there is no traditional competitive bidding process. NPM No. 004-2026 is advisory and does not create a new binding policy.
