The July 2026 advisory
On July 31, 2026, the Government Procurement Policy Board - Technical Support Office issued Public Advisory No. 09-2026 stating that the document identified as the “Implementing Rules and Regulations of Republic Act No. 12009 (1st Edition, as of 31 March 2026)” had been withdrawn and should no longer be used as a reference.
Which version should be used?
The advisory instructs stakeholders to use and cite the IRR approved through GPPB Resolution No. 02-2025 dated February 4, 2025, published in the Official Gazette on February 10, 2025, and effective beginning February 25, 2025.
GPPB - TSO also advised stakeholders not to cite, rely on, reproduce or disseminate the withdrawn March 31, 2026 edition or other unofficial versions of the IRR.
Why suppliers should care
Procurement rules are technical and time-sensitive. Suppliers may encounter cached PDFs, screenshots, summaries or copies that appear current even after an official withdrawal or clarification. Before relying on a rule that affects a real procurement decision, verify the current official issuance and the actual procurement documents issued for that project.
Practical verification steps
- Confirm the issuing authority.
- Check the date of the law, resolution, circular, advisory or IRR.
- Look for later amendments, withdrawals or clarifications.
- Compare the rule with the bidding documents, RFQ, RFP and supplemental or bid bulletins for the specific procurement.
- Use the official government source when a conflict appears.
